Just Great

Looks like the CPUC may have fumbled the ball in California State Supreme Court yesterday on the hearing about the settlement between the CPUC and Southern California Edison.

Gary Cohen, arguing for the CPUC, said the agency feared in 2001 that Edison was preparing to join PG&E in bankruptcy court and that it decided to work out a deal to allow the utility to apply a rate surcharge to pay off debts.

Cohen said it "was not an ideal situation" but that the law did not require the CPUC to negotiate in open meetings but only to vote publicly on the deal.

I sure hope these comments were to the press after the hearing or even before it, and are not a summary of the oral arguments.
